All items purchased from Pixie Gifts are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

However, Pixie Gifts does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Pixie Gifts itself is not as described, your sole remedy is to return it in unused condition.

APPLICABLE LAW

By visiting Pixie Gifts, you agree that the laws of the state of Western Australia, Australia, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Pixie Gifts or its associates.

DISPUTES

Any dispute relating in any way to your visit to Pixie Gifts or to products you purchase through Pixie Gifts shall be submitted to confidential arbitration in Western Australia, Australia, except that, to the extent you have in any manner violated or threatened to violate Pixie Gifts intellectual property rights, Pixie Gifts may seek injunctive or other appropriate relief in any state or federal court in the state of Western Australia, Australia, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgement in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our Shipping and Returns policy, posted on this site. These policies also govern your visit to Pixie Gifts. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Refund policy

Returns & Exchanges 

To be eligible for a return the product must be in the same condition that you received it and in it’s original packaging.  Only damaged items will be accepted, there are no returns for change of mind.

Damages and issues 

Please inspect your order upon receipt and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. Please provide images of the damaged item and post the item back for a replacement item to be sent to you or refund.

Refunds 

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. 

If using Paypal as your payment method, please note that your refund will be the sale amount less transaction fees, as paypal no longer refund transaction fees.

If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Exceptions / non-returnable items 

Certain types of items cannot be returned unless damaged these include custom products (such as special orders or personalized items). Please get in touch if you have questions or concerns about your specific item. 

Unfortunately, we cannot accept returns on sale items or gift cards.

SHIPPING

Within Australia:

Shipping will be via Tracked Australia Post Parcel Post or Express Post.

We cannot guarantee delivery times, however, you should receive your delivery within 7-14 Business days.

International:

We ship to all international destinations, all items will be mailed via Australia post tracked.

International delivery times are 2-6 weeks. If you have not received your ordered items within this time frame, please email us your full name and order number and we will investigate on your behalf.
